EC warns against dangerous precedents as high court hears collation application

The Electoral Commission (EC) of Ghana has called on the Accra High Court to intervene decisively in the collation process for the Tema Central Constituency to safeguard the integrity of the nation’s electoral process.

Through its legal team, led by Justin Amenuvor, the EC urged the court to issue orders enabling it to complete the collation of election results in adherence to the Constitutional Instrument (C.I. 127), which governs electoral processes in Ghana.

Justin Amenuvor argued passionately about the potential dangers of failing to uphold proper electoral procedures.

“If this court does not make the appropriate orders for the EC to go and finish its work in the presence of the very limited number of persons outlined in the Constitutional Instrument (C.I. 127), a dangerous precedent for our democracy will be set,” he stated.

He warned of the chaos that could ensue if unauthorized individuals were allowed to interfere with collation centers.

“All manner of thugs and hoodlums will evade constituency collation centers and, even without the appropriate forms prescribed in the C.I. for the election, raise the hand of somebody holding an A4 sheet and claim that it is done,” he cautioned.

The case, involving a writ of mandamus, is being closely watched as it could determine how electoral disputes are handled in the future.

“If granted, the writ would compel the EC to complete the collation process under strict adherence to C.I. 127, which limits access to collation centers to authorized election officials and party agents.

This regulation is designed to prevent undue influence or disruptions during the collation of results, a critical step in Ghana’s electoral process.
